Terms and Conditions
Welcome to Designlion! These Terms and Conditions govern your use of our services and website. By engaging with our services or accessing our website, you agree to comply with and be bound by these terms. If you disagree with any part of these terms, please refrain from using our services or website.
1. Definitions
1.1 "Designlion" refers to the web design agency, its employees, and its authorized representatives.
1.2 "Client" refers to the individual, company, or entity engaging Designlion’s services.
1.3 "Deliverables" refers to any designs, websites, or other work products created by Designlion for the Client.
2. Scope of Services
2.1 Designlion provides the following services:
User Experience (UX)
Web & Native Apps
Websites
User Interface (UI)
Branding
Social Media Assets
Marketing Collateral
No-Code Development
2.2 Additional services outside the original agreement will require a separate agreement and may incur additional charges
2.3 Designlion offers two subscription plans: Starter at $4,990 and Growth at $6,990, as well as Custom project options with defined scopes, timelines, and deliverables.
3. Project Timelines
3.1 Designlion will provide an estimated timeline for each custom project. Delays caused by the Client, including failure to provide timely feedback or necessary materials, may result in project timeline extensions.
3.2 Any modifications to the project scope may impact delivery schedules.
4. Fees and Payment
4.1 The Client agrees to pay fees as outlined in the project proposal or contract.
4.2 If a custom project is started, a non-refundable deposit of 50% is required to commence work. The remaining balance is due upon project completion, unless otherwise agreed upon.
4.3 Late payments may result in additional fees and suspension of services until payment is received.
4.4 All payments made to Designlion are non-refundable.
5. Revisions and Feedback
5.1 For Custom projects, Designlion will provide a specified number of revisions as outlined in the project agreement. Additional revisions beyond this scope will incur extra charges.
5.2 For Starter and Growth subscriptions, Designlion will provide an unlimited number of revisions.
5.3 All feedback and revision requests must be submitted in writing within the agreed timeframe.
6. Intellectual Property
6.1 Upon full payment, the Client will own the final deliverables. Designlion retains the right to showcase completed projects in its portfolio and marketing materials.
6.2 Any design concepts or drafts not selected by the Client remain the property of Designlion.
7. Client Responsibilities
7.1 The Client is responsible for providing accurate and complete information, materials, and feedback required for the project.
7.2 The Client warrants that any materials provided to Designlion do not infringe on third-party rights.
8. Confidentiality
8.1 Both parties agree to keep any confidential information shared during the project private and not disclose it to third parties without prior consent.
9. Limitation of Liability
9.1 Designlion will not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use the deliverables.
9.2 Designlion’s total liability for any claims is limited to the amount paid by the Client for the services rendered.
10. Termination
10.1 For Custom projects, either party may terminate the agreement by providing written notice. The Client is responsible for payment of any work completed up to the date of termination.
10.2 For Starter and Growth subscriptions, you can pause or cancel anytime from your Stripe account.
10.3 In the event of termination, any deposits or payments already made are non-refundable.
11. Governing Law
11.1 These Terms and Conditions are governed by the laws of Bucharest, Romania. Any disputes will be resolved in the courts of this jurisdiction.
12. Amendments
12.1 Designlion reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website and will become effective immediately upon posting.
